                  RESOLUTION NO. E-188-78-CR

WHEREAS, the Cheyenne River Sioux Tribe is an incorporated tribe
         of Indians having accepted the provisions of the Indian
         Reorganization Act of June 28, 1934, and

WHEREAS, the Tribe, in order to establish its Tribal organization,
         to conserve its Tribal property, to develop its common
         resources and to promote the general welfare of its people,
         ordained and established a Constitution and By-laws,
         approved December 27, 1935, and

WHEREAS, there is no explicit ordinance for garbage and garbage
         hauling on the Cheyenne River reservation, and

WHEREAS, such an Ordinance has been developed by the Tribal Planning
         Office with technical advice from the Tribal Attorney
         General, and

WHEREAS, the Ordinance includes the establishing of the Sanitary
         Landfill project that involves a grant of $72,222 from
         the Native American Economic Stimulus Program for training
         of three personnel in an eighteen month interim period
         and an allocation of $106,000 for equipment and project
         site developments from IHS, and

WHEREAS, the Ordinance also involves the Cheyenne River Sioux Tribe
         as prime contractor to provide garbage and garbage hauling
         to the community of Eagle Butte by sub-contracting with a
         private garbage hauler, now

THEREFORE BE IT RESOLVED, that the Cheyenne River Sioux Tribal
         Council, hereby adopts the Sanitary Landfill Ordinance,
         reserving powers to add, delete, and otherwise amend the
         Ordinance through resolution, and recognize the legal
         establishment of the Cheyenne River Sanitary Landfill with
         its revenues being utilized to maintain and operate the
         project.

BE IT FURTHER RESOLVED, that the Cheyenne River Sioux Tribe delegate
         authority to the Tribal Chairman to negotiate and enter into
         contracts with any parties, programs, agencies, or
         authorities.

                         CERTIFICATION

This is to certify that the foregoing resolution has been reviewed
and approved by the undersigned Tribal Chairman acting under powers
vested in him by Tribal Council Resolution and the Law and Order
Code Book, and acting in the best interest of the Cheyenne River
Sioux Tribe, this 3rd day of December, 1978, in Eagle Butte, South
Dakota.
