                  RESOLUTION NO. 167-81-CR

WHEREAS, the Cheyenne River Sioux Tribe of South Dakota is an
         unincorporated Tribe of Indians, having accepted the
         provisions of the Act of June 18, 1934 (48 Star. 984), and

WHEREAS, the Tribe, in order to establish its tribal organization; to
         conserve its tribal property; to develop its common
         resources, and to promote the general welfare of its people,
         has ordained and established a Constitution and By-Laws,
         and

WHEREAS, the Cheyenne River Sioux Tribal Council did adopt Ordinance
         No. 33 on January 4, 1979 which governs the Sanitary Landfill
         and the disposal of solid waste materials, and

WHEREAS, the Sanitary Landfill is an empty of the Tribal Government that
         does provide a service to the people residing on the
         reservation, and

WHEREAS, the operation of the Sanitary Landfill is funded through an
         annual allocation of tribal funds from the General Fund
         Budget, and

WHEREAS, the revenues derived from the collection of garbage fees is
         deposited into the General Fund as income for the Tribe, and

WHEREAS, the operating expenses for the Sanitary Landfill are presently
         higher than the revenues being collected, and

WHEREAS, the Sanitary Landfill Director and the Tribal Enterprise
         Office has enlisted the technical assistance from the Indian
         Health Service to conduct a feasibility study on the current
         rate table, and

WHEREAS, this feasibility study has determined that there is a definite
         need for the rate table to be increased as it is not
         adequate to meet the operating costs, and

WHEREAS, Ordinance No. 33, Section 4.  Garbage Collection and Disposal
         D.  Service Fees and the Collection Thereof, does authorize
         by resolution the establishment of monthly fees for the
         disposition of all garbage and waste materials, and

WHEREAS, the Industrial Business Development Committee has reviewed
         this recommendation and does recommend approval on a rate
         increase for the monthly fees for the services of the
         Sanitary Landfill, now

THEREFORE BE IT RESOLVED, the Cheyenne River Sioux Tribal Council does
         hereby approve of the recommendation that the rate table for
         the Sanitary Landfill be increased as follows and that this
         resolution be included into Ordinance No. 33:

         1.  Single House Rate:  ....................... $8.00/per month

         2.  Commercial Rate:

             a.  one (1) pickup .......................$ 16.00/per month
             b.  two (2) pickup .......................$ 24.00/per month
             c.  more than two (2) pickups additional
                 charge of ............................$  8.00/per each
                                                       additional pickup
             d.  excess volume of garbage .............$ 8.00/per excess
                                                        volume

         3.  Distance Charges on Homes:

             a.  Single Homes outside Eagle Butte,
                 SD ...................................$ 1.00/additional
                                                      per 10 mile radius
             b.  Single Commercial outside of Eagle
                 Butte, SD ............................$ 2.00/additional
                                                      per 10 mile radius
         4.  Door Service:

             a.  All door service at the landfill will be
                 increased .........................$ 1.00 per category,
                                                       and

BE IT FURTHER RESOLVED, that the new rate schedule will go into effect
July 1, 1981 and the Tribal Enterprise Office and the Sanitary
Landfill will be responsible for the implementation of the new rate
table.

                      CERTIFICATION

I, the undersigned, as Secretary of the Cheyenne River Sioux Tribe,
certify that the Tribal Council is composed of fifteen (15) members,
of whom 11, constituting a quorum were present at a meeting duly and
specially called, noticed, convened, and held this 18th of June, 1981,
Special Session:  and that the foregoing resolution was duly adopted at
such meeting by an affirmative vote of 11 for, 0 against, 0 not voting
and 4 absent.
