Regulation NO. AG-87-1: LETTUCE MOSAIC
(A) Findings.
The Pesticide Control Committee of the Colorado River Indian
Tribes hereby finds and declares that Lettuce Mosaic, a virus, is a
dangerous seed-borne pest which is a serious threat to the lettuce
industry of the Colorado River Indian Reservation. The rules and
regulations contained herein are deemed necessary in order to prevent
the introduction and dissemination of this pest.
(B) Definitions.
For purposes of these regulations:
1) "Covered commodities" means all varieties of lettuce and
lettuce seed.
2) "Mosaic-tested" means submission to a procedure whereby the
existence of and/or extent of infestation with Lettuce Mosaic virus can
be accurately determined. The term "mosaic indexed" shall be deemed
equivalent to the term "Mosaic-tested"
(D) Importation, Transportation, Planting and Sale of Lettuce Seed.
1) All lettuce seed imported, transported, planted or sold within
the Colorado River Indian Reservation shall be mosaic-tested and found
to have zero (9.9) seed-borne mosaic virus infected seeds per 30,000
seeds tested, or the equivalent. Said testing shall be performed by a
seed-testing agency approved by the Pesticide Control Committee of the
Colorado River Indian Tribes.
2) Any lettuce seed imported or attempted to be imported into the
Colorado River Indian Reservation in violation of subsection (1) above,
shall be denied entry into, immediately destroyed or removed from the
Colorado River Indian Reservation under direction of the Environmental
Protection Officer at the and expense of the person in possession or
responsible for the importation of such seed.
3) In the event that any lettuce seed is transported, planted or
sold in violation of subsection (1) above, the Environmental Protection
Officer shall take necessary quarantine and abatement action pursuant
to Section 1-203 through 1-206 of the Agriculture Code.
The foregoing rules and regulations are issued by the Pesticide
Control Committee pursuant to Section 1-103 of the Agriculture Code of
the Colorado River Indian Tribes, pursuant to action taken by the
Pesticide Control Committee on June 14, 1984. These regulations are
effective immediately.
