Notice of Realty Action; Direct Sale of Public Lands in Minidoka=20
County, ID

AGENCY: Bureau of Land Management, Interior.

ACTION: Notice of realty action.

SUMMARY: The Bureau of Land Management (BLM) proposes to sell four=20
parcels of public land totaling 262.11 acres in Minidoka County, Idaho,=20
to the owners of the surrounding private land for the appraised fair=20
market value of $85,200. The private land surrounding the public land=20
is owned by the Western Mortgage and Realty Company.

DATES: Comments regarding the proposed sale must be received by the BLM=20
by August 23, 2010.

SUPPLEMENTARY INFORMATION: The following described public land is being=20
proposed for direct sale to the Western Mortgage and Realty Company in=20
accordance with sections 203 and 209 of the Federal Land Policy and=20
Management Act of 1976, as amended (43 U.S.C. 1713 and 1719), at not=20
less than the appraised fair market value:

Boise Meridian

T. 6 S., R. 24 E.,
    Sec. 30, SW\1/4\SE\1/4\;
    Sec. 31, lots 1, 4, 5, and 6, and SE\1/4\SE\1/4\.
T. 7 S., R. 24 E.,
    Sec. 4, lots 3 and 4.

    The area described contains 262.11 acres in Minidoka County.

    The appraised fair market value is $85,200. The public land is=20
identified as suitable for disposal in the 1985 BLM Monument Resource=20
Management Plan (RMP), as amended, and is not needed for any other=20
Federal purposes. The direct sale will allow for the subject parcel to=20
be formally consolidated with adjacent private property, the owner of=20
which currently holds a land use authorization (Cooperative Farm=20
Management Agreement or Land Use Permit) for agricultural purposes. The=20
subject parcels are somewhat isolated and uneconomical to manage due to=20
their location and authorized use for agricultural purposes. Disposal=20
would alleviate the processing and administration of these land use=20
authorizations, as well as generate funding pursuant to the Federal=20
Land Transaction Facilitation Act (FLTFA) that can be utilized to=20
purchase lands with higher resource values.
    The public land was identified for disposal in an approved land use=20
plan in effect on July 25, 2000; therefore, proceeds from this sale=20
will be deposited into the Federal Land Disposal Account authorized=20
under section 206 of FLTFA. FLTFA directs the revenues generated from=20
the sale or disposal of public lands identified for disposal in land=20
use plans as of July 25, 2000, to an account that can be used by the=20
BLM, the U.S. Forest Service, the National Park Service, and the U.S.=20
Fish and Wildlife Service to purchase lands located within Federally=20
designated areas or with higher resources from willing sellers.

    Regulations contained in 43 CFR 2711.3-3 make allowances for direct=20
sales when a competitive sale is inappropriate and when the public=20
interest would best be served by a direct sale, including the need to=20
recognize an authorized use, such as an existing business which could=20
suffer a substantial economic loss if the tract were purchased by=20
someone other than the authorized user. In accordance with 43 CFR 2710,=20
the BLM authorized officer finds that the public interest would best be=20
served by authorizing the direct sale to the Western Mortgage and=20
Realty Company, which would allow the identified lands to be=20
consolidated with Western Mortgage and Realty Company's adjacent=20
private property to continue to be used for agricultural purposes.
    It has been determined that the subject parcel contains no known=20
mineral values; therefore, the BLM proposes that the conveyance of the=20
Federal mineral interests occur simultaneously with the sale of the=20
land. On August 25, 2008, the above described land was segregated from=20
appropriation under the public land laws, including the mining laws.=20
The segregation terminates: (1) Upon issuance of a patent; (2)=20
publication in the Federal Register of a termination of the=20
segregation; or (3) 2 years from the date of segregation, whichever=20
occurs first. The lands will not be sold until at least 60 days after=20
the date of publication of this notice in the Federal Register.
    The Western Mortgage and Realty Company will be required to pay a=20
$50 nonrefundable filing fee for the conveyance of the available=20
mineral interests. Any patent issued will contain the following terms,=20
conditions and reservations:
    a. A reservation of right-of-way to the United States for ditches=20
and canals constructed by the authority of the United States under the=20
Act of August 30, 1890, 43 U.S.C. 945;
    b. A condition that the conveyance be subject to all valid existing=20
rights of record;
    c. A notice and indemnification statement under the Comprehensive=20
Environmental Response, Compensation and Liability Act (42 U.S.C.=20
9620(W)), indemnifying and holding the United States harmless from any=20
release of hazardous materials that may have occurred; and
    d. additional terms and conditions that the authorized officer=20
deems appropriate.
    Detailed information concerning the proposed land sale including=20
the appraisal, planning and environmental documents and a mineral=20
report are available for review at the Shoshone Field Office at the=20
location identified in the ADDRESSES section above. Normal business=20
hours are 7:45 a.m. to 4:30 p.m., Monday through Friday, except for=20
Federal holidays.

Public Comments

    Public comments regarding the proposed sale may be submitted in=20
writing to the BLM Shoshone Field Manager (see ADDRESSES above) on or=20
before August 23, 2010. Comments received in electronic form, such as=20
e-mail or facsimile, will not be considered. Any adverse comments=20
regarding the proposed sale will be reviewed by the BLM Idaho State=20
Director or other authorized official of the Department of the=20
Interior, who may sustain, vacate, or modify this realty action in=20
whole or in part. In the absence of timely filed objections, this=20
realty action will become the final determination of the Department of=20
the Interior.
