Classification of Public Lands in Clark County, NV

AGENCY: Bureau of Land Management, Interior.

ACTION: Notice.

SUMMARY: The Bureau of Land Management (BLM) examined and found=20
suitable for classification for lease and subsequent conveyance under=20
the provisions of the Recreation and Public Purposes (R&amp;PP) Act, as=20
amended, approximately 15 acres of public land in Clark County, Nevada.=20
The Legacy Vineyard Church proposes to use the land for a church and=20
related facilities.

DATES: Interested parties may submit comments regarding the proposed=20
lease/conveyance or classification of the lands until April 2, 2007.

SUPPLEMENTARY INFORMATION: The following described public land in Clark=20
County, Nevada, has been examined and found suitable for classification=20
for lease and subsequent conveyance under the provisions of the=20
Recreation and Public Purposes (R&amp;PP) Act, as amended (43 U.S.C. 869 =
et=20
seq.), and is hereby classified accordingly: Mount Diablo Meridian,=20
Nevada T. 19 S., R. 60 E., sec. 31: W\1/2\NE\1/4\SW\1/4\ SE\1/4\, W\1/
2\SE\1/4\SW\1/4\SE\1/4\, E\1/2\NW\1/4\SW\1/4\SE\1/4\. Containing 15=20
acres, more or less.
    In accordance with the R&amp;PP Act, the Legacy Vineyard Church =
filed=20
an application for the above-described 15 acres of public land to be=20
developed as a church and related facilities. These related facilities=20
include a sanctuary building (offices, classrooms, kitchen, restrooms,=20
utility/storage rooms, and a lobby), sidewalks, landscaped areas, paved=20
parking areas, youth athletic fields, and off site improvements.=20
Additional detailed information pertaining to this application, plan of=20
development, and site plans is in case file N-75855 located in the BLM=20
Las Vegas Field Office at the above address.
    Churches are a common applicant under the ``public purposes''=20
provision of the R&amp;PP Act. The Legacy Vineyard Church is an Internal =

Revenue Service registered non-profit organization and is, therefore, a=20
qualified applicant under the R&amp;PP Act.
    The land is not needed for any Federal purpose. The lease/
conveyance is consistent with the Las Vegas Resource Management Plan=20
dated October 5, 1998, and would be in the public interest. The lease/
patent, when issued, will be subject to the provisions of the R&amp;PP =
Act=20
and applicable regulations of the Secretary of the Interior, and will=20
contain the following reservations to the United States:
    1. A right-of-way thereon for ditches or canals constructed by the=20
authority of the United States, Act of August 30, 1890 (43 U.S.C. 945).
    2. All minerals together with the right to prospect for, mine and=20
remove such deposits from the same under applicable law and such=20
regulations as the Secretary of the Interior may prescribe.
    The lease/patent will be subject to:
    1. An easement in favor of Clark County for roads, public utilities=20
and flood control purposes.
    2. All valid existing rights documented on the official public land=20
records at the time of lease/patent issuance.
    On February 16, 2007, the land described above will be segregated=20
from all other forms of appropriation under the public land laws,=20
including the general mining laws, except for lease/conveyance under=20
the R&amp;PP Act, leasing under the mineral leasing laws, and disposals=20
under the mineral material disposal laws.

Comments

    Classification Comments: Interested parties may submit comments=20
involving the suitability of the land for a church and related=20
facilities. Comments on the classification are restricted to whether=20
the land is physically suited for the proposal, whether the use will=20
maximize the future use or uses of the land, whether the use is=20
consistent with local planning and zoning, or if the use is consistent=20
with State and Federal programs.
    Application Comments: Interested parties may submit comments=20
regarding the specific use proposed in the application and plan of=20
development, whether the BLM followed proper administrative procedures=20
in reaching the decision, or any other factor not directly related to=20
the suitability of the land for R&amp;PP use.
    Confidentiality of Comments: Before including your address, phone=20
number, e-mail address, or other personal identifying information in=20
your comment, you should be aware that your entire comment--including=20
your personal identifying information--may be made publicly available=20
at any time. While you can ask in your comment to withhold your=20
personal identifying information from public review, we cannot=20
guarantee that we will be able to do so.
    Any adverse comments will be reviewed by the State Director. In the=20
absence of any adverse comments, the classification of the land=20
described in this notice will become effective April 17, 2007. The=20
lands will not be offered for lease/conveyance until after the=20
classification becomes effective.
