Notice of Realty Action--Recreation and Public Purpose (R&amp;PP) Act=20
Classification, New Mexico

AGENCY: Bureau of Land Management, Interior.

ACTION: Notice of R&amp;PP lease and or patent of public land in San =
Juan=20
County; New Mexico.

SUMMARY: The following described public land is determined suitable for=20
classification for leasing and subsequent conveyance to the Aztec=20
Municipal School District <GREEK-I>2, Aztec, New Mexico under the=20
provisions of the Recreation and Public Purposes (R&amp;PP) Act, as =
amended=20
(43 U.S.C. 869 et seq.). The Aztec Municipal School district <GREEK-I>2=20
proposes to use the land for recreational facilities with soccer=20
fields, softball field, restrooms, a changing room and a concession=20
stand and a parking lot and an access road. In the future, another=20
softball field and a baseball field may be added to serve the local=20
children of the area. The identified lands are surrounded on three=20
sides by private land and have a high potential for further residential=20
development.

    The area described contains 32.5 aacres more or less, in San=20
Juan County.

    Comment Dates: On or before October 5, 2007 interested parties may=20
submit comments regarding the proposed leasing/conveyance or=20
classification of the lands to the Bureau of Land Management at the=20
following address. Any adverse comments will be reviewed by the Bureau=20
of Land Management, Farmington District Manager, 1235 La Plata Highway,=20
Farmington, NM 87401, who may sustain, vacate, or modify this realty=20
action. In the absence of any adverse comments, this realty action=20
becomes the final determination of the Department of the Interior and=20
effective October 22, 2007.

FOR FURTHER INFORMATION CONTACT: Contact Mary Jo Albin, Realty=20
Specialist, at the Bureau of Land Management, Farmington Field Office,=20
at (505) 599-6332. Information related to this action, including the=20
environmental assessment, is available for review at the 1235 La Plata=20
Highway, Farmington, NM 87401.

SUPPLEMENTARY INFORMATION: Publication of this notice segregates the=20
public land described above from all other forms of appropriation under=20
the public land laws, including the general mining laws, except for=20
leasing and conveyance under the Recreation and Public Purposes Act and=20
leasing under the mineral leasing laws.
    The lease, when issued, will be subject to the following terms:
    1. The Recreation and Public Purposes Act and to all applicable=20
regulations of the Secretary of the Interior.
    2. The Resource Conservation and Recovery Act of 1976 (RCRA) as=20
amended, 42 U.S.C. 6901-6987 and the Comprehensive Environmental=20
Response, Compensation and Liability Act of 1980 (CERCLA) as amended,=20
42 U.S.C. 9601 and all applicable regulations.
    3. Provisions of Title VI of the Civil Rights Act of 1964.
    4. Provisions that the lease be operated in compliance with the=20
approved Development Plan.
    The patent document, when issued, will be subject to the provisions=20
of the R&amp;PP Act and applicable regulations of the Secretary of the=20
Interior and will contain the following terms, conditions, and=20
reservations to the United States:

    1. A right-of-way thereon for ditches or canals constructed by the=20
authority of the United States, Act of August 30, 1890 (43 U.S.C. 945).
    2. All minerals, together with the right to prospect for, mine, and=20
remove such deposits from the lands under applicable law and such=20
regulations as the Secretary of the Interior may prescribe.
    3. All valid existing rights, e.g. rights-of-way and leases of=20
record.
    Provisions that if the patentee or its successor attempts to=20
transfer title to or control over the land to another or the land is=20
devoted to a use other than that for which the land was conveyed,=20
without the consent of the Secretary of the Interior or his delegate,=20
or prohibits or restricts, directly or indirectly, or permits it=20
agents, employees, contractors, or subcontractors, including without=20
limitation, lessees, sublessees and permittees, to prohibit or=20
restrict, directly or indirectly, the use of any part of the patented=20
lands or any of the facilities whereon by any person because of such=20
person's race, creed, sex, color, or national origin, title shall=20
revert to the United States.
    The lands are not needed for Federal purposes. Leasing and later=20
patenting is consistent with current Bureau of Land Management policies=20
and land use planning. The proposal serves the public interest since it=20
would provide the recreation facilities and related buildings that=20
would meet the needs of the school system and the surrounding=20
population.
    Upon publication of this notice in the Federal Register, the above=20
described public lands will be segregated from all other forms of=20
appropriation under the public land laws, including the general mining=20
laws, except for patent under the R&amp;PP Act and leasing under the=20
mineral leasing laws.
    Classification Comments: Interested parties may submit comments=20
involving the suitability of the land for conveyance. Comments on the=20
classification are restricted to whether the land is physically suited=20
for the proposal, whether the use will maximize the future uses of the=20
land, whether the use is consistent with local planning and zoning, or=20
if the use is consistent with state and Federal programs.
    Patent Comments: Interested parties may submit comments regarding=20
the patent and the specific use proposed in the application and plan of=20
development, whether the BLM followed proper administrative procedures=20
in reaching the decision, or any other factor not directly related to=20
the suitability of the land for R&amp;PP use.
    Confidentiality of Comments: Before including your address, phone=20
number, e-mail address, or other personal identifying information in=20
your comment, you should be aware that your entire comment--including=20
your personal identifying information--may be made publicly available=20
at any time. While you can ask in your comment to withhold your=20
personal identifying information from public review, we cannot=20
guarantee that we will be able to do so.
    Any adverse comments will be reviewed by the Dillon Field Manager,=20
who may sustain, vacate, or modify this realty action. In the absence=20
of any adverse comments, the classification of the land described in=20
this notice will become effective on October 22, 2007. The land will=20
not be offered for patent until after the classification becomes=20
effective.
